Thank you for shopping with Britt Skye Photography LLC by placing your order(s) on www.brittskyephotography.com, you accept the Terms of Sale set forth below. These items may be updated at any time; please check back for updates.

Please note that print and digital download purchases from Britt Skye Photography LLC are for personal use only. Prints cannot be duplicated and/or sold. 

 

Refund / Exchange Policy

Unless otherwise noted, because of the custom nature of any transaction(s) and the prevalence of illegal reproduction facilities, products sold by Britt Skye Photography LLC on www.brittskyephotography.com are non-refundable. Print products are fulfilled by a third-party drop shipper and any replacements or exchanges should be directed to www.millerslab.com or orders@millerslab.com

Britt Skye Photography LLC makes no representations or warranties, either express or implied, of any kind with respect to products sold on this site. Britt Skye Photography LLC expressly disclaims all warranties, express or implied, of any kind with respect to products sold on this site, including but not limited to, merchantability and fitness for a particular purpose. You agree that the sole and exclusive maximum liability to Britt Skye Photography LLC arising from any product sold on this website shall be the price of the product ordered. In no event shall Britt Skye Photography LLC, its officers, employees or other representatives be liable for special, indirect, consequential, or punitive damages related to products sold.

You agree that this limitation of liability is comprehensive and applies to all damages of any kind, including without limitation direct, indirect, compensatory, special, incidental, punitive and consequential damages.

 

Typographical & Photographical Errors

Britt Skye Photography LLC attempts to be as accurate as possible in our pricing, as well as our typographical and photographical depictions of products for sale; however, we cannot guarantee that product descriptions/specifications, pricing or any other content on www.brittskyephotography.com is accurate, complete, or current. If a product is listed at an incorrect price due to typographical, informational, technical or other error, Britt Skye Photography LLC shall have the right, at our sole discretion, to either honor the displayed price or refuse/cancel any orders placed for that product at the incorrect price.

Jurisdiction

Britt Skye Photography LLC is based in the United States of America, and you agree that any legal action brought against Britt Skye Photography LLC shall be governed by the laws of the United States of America without regard to its conflict of law principles. Additionally, you agree that any and all disagreements arising from your use of or orders placed through www.brittskyephotography.com will be adjudicated in the city of Altus, Oklahoma USA by an appropriate court.

 

Sales Policy Agreement

By placing an order at www.brittskyephotography.com, a customer has agreed to the terms and conditions of the sale as indicated on this website. By placing an order at www.brittskyephotography.com, a customer has agreed to the total dollar amount of the sale, and authorized Britt Skye Photography LLC to collect payment via the payment method the customer specified. Britt Skye Photography LLC reserves the right to make changes to this site and these terms and conditions at any time.

Note: Britt Skye Photography LLC attempts to be as accurate as possible in content and pricing. However, we cannot guarantee that the product descriptions/specifications, pricing or any other content on the site is accurate, complete, or current. If a product is listed at an incorrect price due to typographical, photographic, or technical error or error in pricing information received from our suppliers, Britt Skye Photography LLC shall have the right to refuse or cancel any orders placed for product listed at the incorrect price.

DIGITAL IMAGE LICENSE

CLIENT'S USAGE

The Buyer shall only use the digital files in accordance with the permissions within this agreement. The Buyer’s digital files are for personal use only and shall not be submitted to contests, reproduced for commercial use, or reproduced in any way by parties other than the Photographer. The redistribution of digital images is strictly prohibited.

Britt Skye Photography LLC grants Buyer a non-exclusive, non-transferable, perpetual, personal-use license to reproduce Media via print only for any non-commercial use, including but not limited to reprints, enlargements, gifts to family and friends, slide shows, and web pages. Title and ownership, and all rights now and in the future, of and for the Media remain exclusively with Britt Skye Photography LLC. There are no warranties, express or implied. The Media is provided "as is."

 

SOCIAL MEDIA

The Buyer may share Meta Platforms, Inc/Instagram Post and Reels through use of the share functions and dissemination of direct links. All images posted on social media require a direct link or credit towards Britt Skye Photography LLC or @brittskye_photography. Buyer shall not copy, download, screen shot or capture the photographs in any other fashion. Buyer also shall not crop, edit, or add filters to any photographs. This includes any and all Meta Platforms, Inc “automatic” filters.

 

WHAT YOU MAY DO

Personal, Non-Commercial use of the Media includes:

  • Display on personal websites and computers

  • Making image prints for personal use.

 

WHAT YOU MAY NOT DO

Buyer may not:

  • Resell, relicense, sub-license, redistribute without express written permission from the Photographer

  • Use the Media in any way whatsoever in which you charge money, collect fees, or receive any form of remuneration

  • Use the Media in advertising

  • Use the Media in a pornographic, obscene, illegal, immoral, libelous, or defamatory manner

  • Incorporate the Media into trademarks, logos, or service marks

  • Make the Media available for download

Neither Britt Skye Photography LLC nor Britt Skye Photography LLC’s vendors will be liable for any third-party claims or incidental, consequential or other damages arising out of this license or Buyer's use of the Media.

 

LICENSE

All images are property of Britt Skye Photography LLC and are copyrighted by law. No images may be copied, used or published for commercial purposes without clear permission from Britt Skye Photography LLC to do so. 

Britt Skye Photography LLC reserves the right to use all of Client’s images on website, blogs, or any other related marketing material, should the client give permission to do so.
